Visa, Immigration or Fiancé Weddings

If you are an Australian resident and your fiancé lives overseas and is planning to immigrate to Australia on a Fiancé Visa (Prospective Spouse Visa), the Department of Immigration and Citizenship has certain requirements that must be met.

When applying for this type of visa, you will need to provide proof of your intention to marry and that the actual marriage takes place within nine months of your partner arriving in Australia.

To meet these requirements, you will need to –
  • arrange with an authorised celebrant to marry you
  • Either fully or partially complete and lodge a Notice of Intention to Marry document that has been signed by at least one of you, with your celebrant
  • Obtain a letter from that celebrant stating that you have paid a booking fee and lodged the Notice of Intention to Marry document with her.
It is easy to commence the process of arranging a wedding which includes applying for a visa – firstly, make an appointment to meet me and bring to that meeting –
  • A date for your ceremony and preferably a venue for it
  • An official copy of your birth certificate and a photocopy of your fiancé’s birth certificate
  • If you or your fiancé has been previously married, I am required to see the original documentation of how the marriage terminated ie Certificate of Divorce or Death (a photocopy of your fiancé’s documentation if applicable).
  • Photo identification such as Driver’s Licence or Passport
  • The booking fee to hold the date for your ceremony and for me to provide you with the letter for Immigration.
Some couples choose to have their legal marriage ceremony take place in Australia and then have a cultural/tradition styled wedding in their home country.  This is perfectly acceptable providing the second wedding is not recognised as a legal wedding in that country.

I suggest that to ensure that you have met all the requirements of the Dept of Immigration, it may be wise for you to consult a registered Immigration Lawyer or specialist as I cannot provide any advice in this regard.
